This COPPA NOTICE: Direct Notice to Parents ("COPPA Notice") gives parents additional information on the practices of My Lemonade Stand, PBC d/b/a My Lemonade Stand, Inc. ("Company"), a Delaware corporation, in collecting and using personal information from children under 13 years of age with regard to the Company's Web site (the "Site"). The Company's Privacy Policy ("Privacy Policy") and the Company's Children's Online Privacy Policy ("Children's Privacy Policy") describe how the Site collects and uses personal information. In addition, the Site's use is governed by the Company's Terms of Use. You can review the Terms of Use, Privacy Policy and its Children's Privacy Policy by navigating to the Site at www.mighty.business and clicking on the words "Terms of Use," "Privacy Policy" and "Children's Privacy Policy" at the bottom of the page.

Who operates the Site?

The Company developed and operates the Site as an interactive Web site to promote entrepreneurship among children and educate them how to operate their own businesses. Certain companies including, but not limited to, internet and public relations service providers ( collectively, "Service Providers") may assist the Company with respect to its Web sites. The Company is the sponsor of the Site. Service Providers may provide other services, such as technical support, or analyze the performance of the Site.

What information does the Site collect and use?

Certain non-personal information about visits to the Site is recorded by the standard operation of the internet servers on which the Site is hosted. The nonpersonal information that we collect may include IP addresses, the type of operating system in use ( e.g., Android, iOS, Windows, or Macintosh), the type of browser being used by the visitor (e.g., Google Chrome, Internet Explorer or Firefox), the number and frequency of visitors to the Site, and the site the visitor was on immediately before visiting the Site. The Company may collect certain non-personal information from children by using small text files known as cookies. We use cookies for several purposes, such as to recognize visitors to our Web sites, to determine the number of unique visitors to our Web sites, to ascertain which web site pages they visit, and to conduct internal reviews of our site. You are always free to decline cookies, but in doing so your child may not be able to use certain features on our Web sites. In connection with registering an account on the Site, the Company also collects certain personally identifiable information about your child, including their first and last name, date of birth, gender, zip code, email address, unique username, password, and secret question (as a reminder for a forgotten password). The Company will also request the parent's (or guardian's) first and last name, mailing address, phone number, date of birth, gender and email address. Personally identifiable information of children under 13 is only collected with parental consent, and if the Company becomes aware of a child under the age of 13 providing personal information without parental consent, we will attempt to delete that information.

How does the Site collect this information?

As described in the Privacy Policy and Children's Privacy Policy, to permit your child to create an account and register with the Site, the Company requires you to complete, sign and return the Parental Consent Form attached to this COPPA Notice (the "Consent Form"). After you have returned the Consent Form, which includes the child's first and last name, date of birth, gender and e-mail address, the child is enrolled as a member and will be contacted via e-mail at the address provided in the Consent Form (or at the parent/guardian's address, if no e-mail address is provided for the child). We may then obtain additional information, including personally identifiable information, to supplement the information provided by you in this Consent Form. As described in the Company's Privacy Policy and above, the Site may also use cookies to enable your child to sign in, to help personalize the Site, and to help the Company administer the Site.

How will the Site use this information?

The Site uses the personally identifiable information provided by the parents and children to create a unique user account for your child and administer that account. With this account, your child will be able to create their own online storefront, from which they can sell curated works from artisans around the globe and learn how to run their own business.

Does the Site share this information with any third parties?

The Site only uses personally identifiable information about children for internal operating purposes and does not share personal information received from parents or children about children with third parties, except as required to: 1) run the internal operations of the Site; 2) in response to judicial process; 3) to comply with legal requirements; and 4) as permitted under provisions of law to provide information to law enforcement agencies, in connection with an investigation on a matter related to public safety, or as permitted by law to protect our rights or property, the Site, or its users. The Company may transfer or otherwise disclose certain nonpersonal information it collects from children or parents to employees and independent contractors of the Company, its subsidiaries, affiliates, and internet and public relations service providers if the disclosure will enable that party to perform a business, professional, or technical support function for the Company, or ifrequired to do so by law. Except where required in order to provide service to the Company, any such information shall be stripped of any personally-identifying characteristics, and the Company will not share personal information such as the child's first and last name, the child's address, the child's e-mail address, the child's telephone number, a persistent identifier associated with individually identifiable information, or any information collected from the child that is combined with a persistent identifier. While the Company takes measures to ensure the confidentiality of personal information collected from children, the entities to whom personal and nonpersonal information may be disclosed may not be subject to any formal confidentiality requirement.

How does the Site get consent from parents for the collection of personal information?

To create an account on the Company Site, a parent or guardian must complete, sign and return the Consent Form, in which the parent or guardian (a) provides information about the parent and his/her child (b) consents and agrees to follow the Site's Terms of Use, and (c) consents to the Site's practices in collecting and using personal information from children under 13 years of age as specified in the Privacy Policy, the Children's Online Privacy Policy and this COPPA Notice.

A parent's or guardian's affirmative consent, as evidenced by a completed and signed Consent Form, means that such parent or guardian consents to the collection, use and disclosure of the personally identifiable information of his or her child in accordance with this COPPA Notice, the Privacy Policy, the Children's Online Privacy Policy, and the Company's Terms of Use.

Can a parent review, change or delete the information collected by the Site about his or her child?

A parent can at any time review or change the information collected by the Site about his or her child by contacting the Site. Parents or guardians may consent to the collection and use of their child's personal information without consenting to the disclosure of that information to third parties. A parent or guardian can also refuse to permit the Site to collect any further personal information and can request that the Site delete any information already collected.
